6.1 All prices displayed are in Australian dollars and include GST unless otherwise stated.
6.2 Delivery charges, where applicable, will be displayed during checkout.
6.3 Prices, promotions and availability may change without notice.
7. Orders
7.1 By placing an order, you confirm that the information you provide is true, accurate and complete.
7.2 You must be at least 18 years of age to purchase alcohol. You will be required to provide your date of birth when placing an order unless you have previously provided it to us.
7.3 All orders are subject to acceptance and product availability. We reserve the right to decline or cancel an order where reasonably necessary, including where a product is unavailable, a pricing error has occurred, or we are unable to lawfully supply the order.
7.4 If a particular vintage becomes unavailable, we will contact you before substituting another vintage unless otherwise stated at the time of purchase.
8. Delivery
8.1 Delivery charges and available delivery options will be provided during checkout.
8.2 Alcohol may only be delivered in accordance with applicable liquor licensing laws.
8.3 The person receiving a delivery of alcohol must be aged 18 years or over. Proof of age and identity may be required upon delivery.
8.4 Alcohol will not be delivered to a person under 18 years of age.
8.5 Where permitted by law, an order may only be left unattended where the purchaser has specifically instructed CW Wines or its delivery provider to do so.
8.6 Delivery times provided by us are estimates only. We are not responsible for delays outside our reasonable control.
8.7 We may delay dispatch during periods of extreme weather where we reasonably believe conditions could adversely affect the quality of the wine.
9. Payment
9.1 Payment must be made using one of the payment methods available at checkout.
9.2 Payment for the goods and any applicable delivery charges must be received before an order is dispatched.
9.3 Payment information is processed using secure third-party payment services. CW Wines does not retain complete credit or debit card details unless expressly stated otherwise.
10. Returns, Refunds and Consumer Guarantees
10.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
10.2 If goods are faulty, damaged, incorrectly supplied or otherwise fail to meet a consumer guarantee, please contact CW Wines as soon as reasonably practicable so that we can arrange an appropriate remedy.
10.3 Depending on the circumstances and your rights under the Australian Consumer Law, this may include replacement, refund or another appropriate remedy.
10.4 Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or other applicable legislation.
11. Liability
11.1 To the extent permitted by law, CW Wines is not liable for loss or damage arising from use of this website or reliance on information contained on it, except where liability cannot lawfully be excluded.
11.2 Nothing in these Terms & Conditions is intended to exclude or limit any consumer guarantee, right or remedy that cannot be excluded or limited under Australian law.
12. Responsible Service of Alcohol
12.1 CW Wines supports the responsible service and consumption of alcohol.
12.2 It is an offence to sell or supply alcohol to, or obtain alcohol on behalf of, a person under the age of 18 years.
12.3 By purchasing alcohol from CW Wines, you confirm that:
you are aged 18 years or over; and
any person for whom you are purchasing alcohol is aged 18 years or over.
12.4 We reserve the right to refuse or cancel an order where we reasonably believe the purchase or delivery would breach applicable liquor licensing laws.
12.5 Some Australian locations may be subject to restrictions on the sale or delivery of alcohol. We may decline or restrict delivery where required by applicable laws or regulations.
13. Governing Law
13.1 These Terms & Conditions are governed by the laws of South Australia, Australia.
